SD v RFC Judgement

Surely if we are forced back into the 7 year onerous contract we will be due back the £3 million we have paid them to get out of it ?

It can’t be as bleak as some are suggesting .
It was a 7 year deal and I think there are 4 years left .

We appear to have swapped that 7 year deal for one that will give SDI the right to match any deal we can elicit - in perpetuity. For ever. We will probably struggle to get anyone other than SDI to even make an offer in future given this shambles, so we are, well and truly, shafted.
 
The biggest farce in this is that the club willingly walked into this mess. At least the old deals were signed by his cohorts.
We should’ve left the old deal to run it’s course and washed our hands of him saving us many millions in the course.
 
There is no end date for the "matching" clause. It is there forever by the looks of it.

There is an injunction already. What I mean is this has been happening for 2 months, surely if Elite wanted to pull the pop up they would have? Except they pressed on with it.

So basically, we can get income from our own merchandise again. But only if we swallow our pride (Rangers and the support) and go back through SD who f*cked us over for years?
 
The sickening thing is that the fat c.unt is sitting laughing at us at how he has our board still wrapped round his fat fingers on all of this - and how easy it was for him.
 
Can’t beleive we are going to be boycotting strips again next season after seeing all the kits on show all over Scotland just now.

It's at the stage where the Board need to communicate with the fans on this, as many are pumping money into strips and merchandise that may well be passed to Sports Direct in the form of compensation.

From where I sit, the Learned Judge has gone by the contract written between us and SDI. We all know that SDI had their placemen on Rangers at the time and they were the ones who signed this ridiculous deal. There really is nothing we can do about it until it expires except to mitigate the damage these unscrupulous individuals have caused us. We can appeal everything and wait until we are in a better monetary position before offering SDI a settlement that the fat man can accept. Unfortunately, the Learned Judge can only go by the written contract in front of him and that is his only route.

Does the contract have a end date? I thought the contract said as long as SD match the offer of any other retail offer then they are our distributors for the rest of time. Surely a judge sees that the relationship is irretrievably broken and finds a way to end it even if it costs us x millions. I think at this time the board would take it

The judgement says that an injunction is justified and the judge will give thought to what terms are appropriate. My understanding is that at that point he might decide to prevent the elite shops from selling stuff. I'm an accountant not a lawyer though
 
I agree with this, the only thing we have got right in the last few years is appointing SG.
Fucked up with many previous appointments and have fucked up spectacularly in all dealing with Ashley.
SG blinded loads to the boards failures. and I’m concerned about the pressure on himin Europe this season to mitigate these screw ups. You can guarantee there will be pressure for that. Finally we are feeling hugely positive and along come our regular failings to swipe the feet from under us. Resilience should never be a question aimed at our fans. We’ve had several lifetimes of grief in 6 years.
 
Whoever was involved in this fiasco and thought we were doing everything above board should be removed from club immediately

First thing that should have been looked at was the contract between us and that fat wxnk
It clearly has not been looked at or worse it was an some inept clown thought we could walk away without repercussions, that for me is a sackable offence
 
I think the club were hoping we'd have to pay damages but be free of the contract. Sounds like we'll now have to pay damages and also be stuck in a contract with a toxic partner that has no interest in a mutually beneficial relationship. Great.
Monumentally stupid for the club to think that was the case. I doubt they did but Jesus wept if that was the case.

No one could think a court would just encourage non performance of contract like that by saying oh pay some damages and everything goes away. Strikes at the very heart of the principle of intention.
 
It's an absolute conflict of interest to have Blair on the board and instructing solicitors in a case such as this. Surely to Christ we had specialist solicitors looking over this prior to attending court? The whole thing is a mess.
 
I'm no expert, but King needs some very high powered independent consultancy advice on this and should have gone down that road when he first took office.

It looks as though he has tried (and failed) to be clever - he now needs to bite the bullet and face up to the support on this (notwithstanding the appeal) - if there is no way out, tell us - if there is a way out make sure its legal then do it and tell us

I think the board thought they would get a offer that sports direct wouldn’t match because the terms suited us over them. So they would walk away. However it’s obvious now Ashley has no interest in the money and it’s just spite from him. Honestly have no idea how we get out of this.
 
Seems like our 'legal team' were a bunch of inept idiots that have basically fooked us up really badly!!

Let’s just say that’s possible The problem the board have is football clubs arnt normal businesses. In normal terms a business would sell a asset pay the x millions and get rid of the contract. However imagine we sold moreles to pay Ashley and didn’t buy a replacement . The fans would be in outrage and at this point with them so close to 10 is that really a option .
 
It doesn't look great, and I dont think the judge has been made fully aware, or maybe he cant take into account that if SD get the retail deal we will most likely boycott the hell out of it and buy from other sources as the deal will be non exclusive. Paragraph 95 if anyones interested.
 
There MUST be some deal we can come up with that would completely dissuade SDI from matching it.

The simple solution would be to offer a deal to, let's say Elite, that says they must sell a certain number of strips (this figure could be based on historical data from a certain period, for example the last 20 years), and if they don't sell that number of strips they have to pay us compensation (a cash amount that would cover selling those strips).
Clearly, if Elite (or whoever) got the contract,they would have no problem reaching that figure...whereas if Fat Boy got the contract and we boycotted him again, he'd have to pay us for all the unsold strips.

Surely it can't be too hard for the club to come up with a deal like this??

For all saying that the clubs appealing and merch will still be on sale that’s great.

BUT who is gonna want to buy with the now very likely outcome that it’s going to SD and Cashley?

King made a grandstand of his victory over SD, since then they’ve bent us over time and again. It’s embarrassing more than anything else.
 
But this would have been known as of last week, the same week the pop up started. It doesnt add up.

The pop up that Marshall made extremely clear in various posts had been set up directly between him and Elite with no input, advice or contact with Rangers. ;)
