THE two administrators of Rangers FC who were the victims of malicious prosecution by the Crown have been paid more than £20m, according to an insider.

David Whitehouse and Paul Clark won an admission in court by the Lord Advocate, James Wolffe QC, that they had been maliciously prosecuted over their involvement in the administration of the then incarnation of Rangers which was eventually liquidated.

They had previously been awarded interim payments and had settled out of court with Police Scotland for six figure sums.

The Crown Office and Procurator Fiscal Service (COPFS) is thought to have accepted the two men’s evidence as to the damage done to their reputation and standing.

The National can reveal that the Lord Advocate is to address the Scottish Parliament on the matter, and there is concern in Scottish Government circles as to where the money will be found to pay the compensation which sources close to Whitehouse and Clark say was £21m in total, plus a further £3m in legal expenses.

“The money is in their bank accounts,” said the insider. “All they want now is a proper public apology.”

Further admitted cases of malicious prosecution are still to be resolved with Charles Green, former chief executive of Rangers, and former commercial director Imran Ahmad both set to receive compensation likely to run into eight figures in total.

Former justice secretary Kenny MacAskill last year called last year for an inquiry into the malicious prosecutions “scandal”. Told by The National of the figures already paid he asked where the money would come from “in these times of crisis”.

MacAskill stated: “This has caused consternation, and even anger, both within the service and in the police where rumour has it that it’s a position strongly disagreed with.

“The cost to the public purse will be massive but the reputational damage to the Crown Office is incalculable.”

Asked to confirm the payments, COPFS said: “The cases are still before the court and in order to respect the processes underway we will not comment at this time. The Lord Advocate has made clear that he will support appropriate public accountability and intends to make a statement to the Scottish Parliament in due course.”

A Scottish Government spokesperson said: “It would not be appropriate for the Scottish Ministers to comment.”

Looking back on it, we never stood a chance the minute D&P were appointed as administrators - see a lot of previous Ashley’s SD acquisitions, you’ll notice the administrators involved in any prepack admins were D&P.

Anyway, this week in 2015 Dave King and others saved the club....shudder to think where would be just now or what assets the club would have left had he not taken over.

If you look at the link it came from the Evening Times - despite it saying in the text it’s from The National. They are sister papers and the only ones carrying the story.

There has to be an investigation into the incompetence of the COPFS in this affair.

Surely the decision to prosecute these two and the others was done on the basis of a solid expectation of a successful outcome? To now be shelling out £24m, with more to come for the other chancers, is just disgraceful.

It seems everyone involved in the rape of our club has profited, whilst the criminal conspiracy to plunder Rangers is quietly forgotten about.

They never miss the chance to get a sly dig in to ‘ease their pain’. Doesn’t detract from the shameful outcome to all of this - with more to come from the other crooks. Be interesting to hear what the Lord Advocate has to say in Holyrood. Be a whitewash no doubt but it’s huge sums of money here at a time when cash is short.
 
All the wrong people in life get the dough, we were wronged by so many during that black period and all the baddies in the fight have emerged without a scratch.
 
I remember Dave King said we’d take the old company out of the liquidation process and ‘cist’ it when the new company a while back. Does anyone know if plans are still in place for this?
Dave King has been pretty bang on for the “house of cards” stuff and also playing a major part in sorting out our retail. This to me would be the cherry on the cake for what he’s achieved and the part he’s played in the celebrations we’ll see in the next couple of months will never be forgotten.

Problem a lot of the time is fraud is difficult to explain to the normal person. Even if it seems clear cut.

I can't remember if this went on front of a jury or not but if it did then in Scotland that's a problem already with the hate against rangers that was built up.

I know scottish and English laws are different but a case like this should have been tried elsewhere. As well

Wish people would stop saying police incompetence or pf incompetence. This was planned from the very start. These scumbags thankfully made 1 huge mistake, they thought nobody like King, the 3 bears and so on would emerge to save us.

The case should never have made court. Technically Whyte did have access to funds for making the purchase, it’s how these funds were going to be gathered that was the problem. Therefore the initial charges of fraud etc, would never have stood up in any court.

I said on a few threads at the time that this was potentially stock market related and should have been under the investigative control of the City of London Police, Police Scotland, in my opinion, don’t have the calibre of fraud detective that would have been required here.

Nothing will ever convince me that these two charlatans and big ol Yorkshire hands weren’t in cahoots with Shyte from day one.

Absolutely botched by police and PF sheer incompetence. As others have said, this is one that should properly have been investigated by city watchdogs and specialist stock market fraud investigators.

The fact that nobody will ever be done for the rape of our club will forever leave a bad taste in my mouth, to say the least.

Here's the thing. These guys spent time in the cells, and had their reputations ruined. They believed in their innocence, and sued the police and crown.
Police Scotland settled with both out of court, and the Crown apologised to both for a malicious prosecution. Something that has never happened before.
If anything it looks like the crooks this time are Police Scotland and the Crown. Not the two D&P administrators.
The administrators demonstrated they knew the law during our administration, winning against Ticketus and the SFA. These guys were competent. Now they have successfully wiped the floor with Scottish justice and taken 20m+ from the public purse. If ever an inquiry was needed it is into this absolute fiasco. WTF went on here?

If it is ever proven who was originally responsible for this whole episode ( let's say a sex pest who knew the song book) then they should be seeing jail time.

I'd say there's a very real chance that the Scottish Government could end up paying out more in compensation and Court costs than the figure that is accepted as our final bill to HMRC by the time BDO are done negotiating. Let that sink in for a while.
 
The taking Duff and Phelps to court was completely separate from HMRC not accepting a CVA and we need to keep these separate.

The CVA, with hindsight, would have been equal, or possibly less, than what us creditors have currently received via BDO. This is being missed by a lot of people.
 
I would not be surprised if these cünts do not seek out people like white and coach them through the process where everything is legal and everyone gets a payday
 
The PF would have been looking at the evidence obtained. It’s Police Scotland who when they gathered the evidence accidentally or deliberately did it such a way as to destroy the case by exceeding the scope of the warrant.

I don't now. Wolves paid £35m for teenager Fabio Silva so £21m for two experienced guys is maybe not so bad a deal.

On the other hand, was agreeing the deal with Green in advance of the CVA being rejected - and in view of the late offer from The Blue Knights etc - all above board and kosher? I'm not so sure.

Yes it was as the Blue Knights missued the deadline. As frustrating as it was they played by the rules.

The deadline didn't matter - Duff and Phelps had already done the deal with Green mate. Nothing was changing that.

We will find out in due course, naturally, because BDO are suing D&P for circa £25m so that dosh might not stay in their accounts for too long (yes, I know if BDO win it will be D&P insurance that pays out).
