Footballer Declan Gallagher who was convicted of brutally attacking a man at a Blantyre hotel has been re-signed by Livingston FC.

And in a statement released by the Scottish Championship side today, Gallacher is described as a "victim", report the Daily Record.


Livingston defender Declan Gallagher, 24, received a three-year sentence in June this year for a baseball attack on Steven Findlay at the Parkville Hotel, Blantyreon April 21, 2013, along with co-accused 29-year-old hairdresser Anthony Murray.

He is appealing his conviction and has been released on bail while that appeal is pending.


Today, Livingston FC announced that they have decided to re-sign Gallagher until his appeal is concluded and appeared to give their backing to the player, saying his was involved in a bid to "clear his name."

The statement on the club website reads: "Livingston F.C. has decided to re-sign Declan Gallagher until such times as his appeal is heard and concluded.


"The verdict of the Appeal Court will be a significant factor in the long term future of the player with the Club. At this stage the High Court of Justiciary has considered it appropriate that he be granted his liberty pending the outcome of the Appeal.


"We are of the view that whilst he is on bail he should be provided with the opportunity to earn a living and to support his family whilst he continues with the fight to clear his name.



"We appreciate that in this process there are many victims, including Declan, and that not everyone will be comfortable with the approach adopted by the Club. The Club, however, is not in a position to make judgement.

"Livingston FC hopes that fans and sponsors will recognise and appreciate the approach we have adopted and allow the judicial process to take its course."



The trial at Hamilton Sheriff Court which saw Gallagher convicted had heard how trouble flared up at an anniversary party at the Parkville as Stephen Findlay and Marie Dockery were leaving. Ms Dockery had described the force of the blows as “absolutely brutal”.

The assault caused two massive splits to Mr Findlay's head and left him with a fractured skull and bleeding on the brain.

Murray was also found guilty of assaulting Ms Dockery to her injury – by seizing her on the body, forcing her to the ground, punching her on the head and striking her on the body with his knee - and was sentenced to four months’ imprisonment on the charge which was to run concurrently with the three-year term.

Declan Gallagher, 25, was sentenced to three years in prison after being found guilty of assaulting a chef outside a hotel.

Victim Steven Findlay suffered a brain haemorrhage in the incident which happened in Blantyre, South Lanarkshire.

But Gallagher has now been released from prison and immediately made a goal-scoring return to table-topping League One club Livingston.

The former Dundee and Celtic defender said: “I’m thankful to the club for bringing me back after a very tough time in my life.

“I’m really looking forward to getting back into a routine again.

“It’ll be great to get back into the changing rooms and have a laugh with the boys.

“I’m just trying to blank everything else out that people have been saying.

“I’m staying focused on helping Livingston to reach the top.”

Appeal judges rejected Gallagher’s challenge against the conviction last February.

During his release on bail before his case was heard he made 30 appearances for the West Lothian club in the first half of the 2015/16 campaign.

On his day-release work placement from prison, he trained regularly with Championship side Raith Rovers.

He carried out the attack alongside hairdresser friend Anthony Murray at the Parkville Hotel in Blantyre in April 2013.

Their victim spent five days in intensive care following the attack and said he felt “let down” by the justice system after it was revealed his attacker was being let out on day release.

Speaking last year, Steven Findlay said: “When they were convicted, I was glad.

“But then they were let out while they waited on an appeal hearing and it was difficult to see Gallagher parading around the pitch without a care in the world.

“Then we were glad when they were sent back to prison. I thought it was finally justice served.

“But then friends spotted pictures of the pair of them at family events with pictures plastered all over Facebook.

“They could’ve killed me but yet no justice has been served.”



Demi Gallagher defended her brother Declan on Facebook, following a string of negative comments from supporters.

She wrote: “My brother has only ever wanted to play football since way before he could walk. He has put his life and soul into the game and missed out on many things.

“To everyone saying he is not a role model I have to disagree, I have watched my brother chase after his goal all his life.

“He has achieved so much that many of us couldn’t and for that he will always be my role model.”

She added: “My brother has lost one of the most important years of his life with my niece being born.

“She still smiles away every time she sees her daddy.

“Our family has been ripped apart but we still stay strong as it is the opinion of the many people who know us and Declan that really count.

Scumbags, his cousin and co-accused set about the victims girlfriend that night as well leaving her in a bit of a mess, not the first time he’s struck a female also. Lovely family of mentally challenged stock.

Got out after very lenient sentence and much because Livi backed him and pleaded with the parole board, stating he had a baby on the way and that Livi would pay to put him through anti violence rehabilitation courses and CBT courses to assist him. Scumbag.

This pathetic ‘punishment,’ and the functioning of the Scottish ‘justice,’ system in this case shows that they are unfit for purpose. He should have got 10-15 years and been made to serve every fuucking day.
